I just saw on my local news that Virginia plans to sue the Federal Government if Obama signs the Health Bill into law because it overreaches the limits of Congress. They do not believe that the government has the right to force anyone in the Commonwealth to have to purchase something that they may not want or need.
What’s your take on this? Do you believe such a lawsuit could ever take hold? Do you think other states will follow?
Wow I had no idea so many states were preparing to file lawsuits.

There are a total of 38 states prepared to file lawsuits.
I believe they have a strong case, the government cannot force a product upon its citizens.

Lawsuit has basis on the Commerce Clause, Free Excise Clause, and Amendment X.
Really this ruling has galvanized nullification and States Rights. It is very good for the Republic.

Actually, it would not be an overreach. The Constitution gives the government the right to spend and tax for general good of the people:
“The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and GENERAL WELFARE of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;”
Article 1, Section 8 (Enumerated powers of Congress) (Emphasis added)
It will be a waste of money. Their arguments are not based off of any factual basis anyways. The bill does not force anyone into government-run health care.

Why do people believe that just because we are required to carry health insurance that America has become a communist nation? If you drive a car your required to buy car insurance. If you don’t own a car and you were required to carry car insurance, well now that would be unfair and beyond communistic. But people, every human that lives, owns his or her health! If not, you would be dead! You have car insurance in case you break another car and/or if your own car breaks right? Guess what just like a car our health breaks at one point or another no matter how simple, and some people break other peoples health either intentionally or accidentally. That’s why you have to carry health insurance. Its not “communism”, its “common” sense! You don’t have to buy a car and the insurance cars require. You can just decide to walk or take a bus. But you have to have health in order to live. So why not health insurance?

I think it is an interesting idea but I doubt they would get very far. I don’t think it would ever take hold and I don’t think other states would follow especially the more liberal states.

Good for Virginia, as well as Alabama, Florida, Michigan, Nebraska, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah, and Washington. They are all suing the government for this unconstitutional bill that forces people to buy healthcare or pay a fine.

The suit maybe successful but it will be appealed all the way to the Supreme Court, and that will take at least two years AND the Supreme Court may not hear the case. So depending on the lower courts rulings it could go either way.
Btw, even if Virginia wins that will not make the entire bill invalid.

38 states were planning to block the healthcare bill. It is unconstitutional because no where in the constitution does it give Congress the power to do this. So, this power is technically reserved to the states. Constitutionally the lawsuit should take hold.

pockets . This type of thinking could possibly cause Virginia to also feel the wrath of the
Obama legislature.You can lose many millions of dollars by not going along with the program.

The atty’s general of 37 or 38 states (and counting) are considering similar challenges. Considering only about 20-some states were “red-states” in ’08, the ground is obviously shaking beneath the two-party system.

I think the supreme irony would be this:
If these lawsuits succeed, the only way to assure all Americans access to affordable health care might very well be to create a single-payer tax-funded system like they have in France, Canada, and England; or to regulate insurance companies as heavily as they do in Germany and Japan (though some might still squawk that that would still be mandating that citizens purchase a product).
Nobody in any of those countries I mentioned ever goes bankrupt over medical bills, in fact most never even receive any bills at all.
We pay into Social Security and Medicare all of our lives, to start receiving benefits only after we are 65 or so…what’s the difference? Do you want to opt out of Soc Sec? When you retire will you turn down your Medicare coverage?

Well the AG here in Michigan is filing suit also, it’s against the Constitution, The Government can’t make us pay for Health care, or any product for that matter. When Obamacare FORCES People to buy Health care Sorry WRONG! I am 53 years old and I have been to the Doctor 7 times in my life time. I would rather see the Congress and Senate work on finding ways to Lower Health Care Costs, Make it more affordable for People instead of telling People They Have to Buy It. This is Socialism that’s all this is. Obama wants the People to depend on the Government. He doesn’t want People to have Jobs or he would have worked on turning around the Economy instead of FORCING Health Care on US. Midterm Election will show what happens to People who Voted for Obamacare.

Here’s an interesting parallel: If this lawsuit actually gets any traction, I’m going to sue for being forced to “purchase” the Iraq war with my tax dollars.
Since Congress NEVER officially declared war on Iraq, as stipulated in the Constitution, Bush’s “pre-emptive war” was an over-reach of his Presidential authority, and therefore, I should not be *forced* to pay for it.
Oh, and by the way, the Iraqi Constitution, which was written by Americans, INCLUDES universal health care for Iraqis. So we’ll pay for theirs, but not our own? Why should I be FORCED to pay for Iraqi health care?

Lets not stop there. Lets sue state governments for making us have to carry auto insurance as well. I mean I have never had an accident in a car in my lifetime because I drive defensively, so why should I have to have insurance.

No one is required to have car insurance. You can have minimum coverage amounts in trust, that is only touched in the event of an accident. You legally do not require car insurance whether you drive or not. And if you’re perfectly healthy why would you want to pay funds for insurance when you could live your life to the fullest with no medical problems right up to the point of death. No where in the constitution does it require anyone to purchase anything. This is just a power grab by the dems. They will demand campaign donations and support for Obama’s next election from the insurance corporations. Obama is so full of it his eyes are brown and when he blinks he takes a crap, and that goes for all the other democrat supporters as well..
